(Scroll down for video) The family of a Georgia man, who died when his heart stopped while having a three-way sex romp, was awarded a $3,000,000 payment by a jury, according to court proceedings.

Guillermo Martinez’s family was originally seeking $5 million in a medical malpractice case against a doctor, who did not warn him about having a threesome.

While members of the Gwinnett County jury sided with the family on Tuesday, they agreed to a smaller amount after finding Martinez was 40 percent responsible for his own death.

Martinez, a husband and father of two, was involved in a threesome with a friend and another woman, who was not his wife. He died March 12, 2009.

Martinez has gone to the Cardiovascular Group in Lawrenceville, Georgia, complaining of chest pains that shot into his arm.
A test was scheduled for eight days later, but the day before the test he decided to participate in the out of wedlock shenanigans.

His lawyers argued that assistant cardiologist forgot to tell Martinez to refrain from getting too physical, and refrain from having any sexual activity before the test was conducted.

Martinez's legal team said he had high blood pressure and his heart was at risk because of clogged arteries.
The trial began Monday in state civil court.

The doctor's lawyer said: "We're definitely going to appeal the verdict and sentence."
