Woman wins $450,000 lawsuit against her father who sexually abused her

A father is supposed to protect his child, but one mean-spirited father used his fatherly authority to sexually abuse his trusting daughter. He abused her from age two until she was 12-years-old.

Under normal circumstances, victims stay anonymous, but in this case, the woman waved her right to anonymity so that her father could be named in public.

After the suspect was jailed, Ailish Smith, 38, from Clarehall, Dublin, sued her father in civil court for sexually abusing her in 1980 and she was awarded $450,000.

Her father, Gerard Smith, of Magenta Hall, Santry, Dublin, pleaded guilty to five counts of sexual abuse of his daughter, which he committed when his wife was out of the house. Smith was sentenced to six years in prison.

Smith filled an application to dismiss the lawsuit on the grounds of the case being past the statute of limitations. The judge dismissed the application and ruled that the daughter was entitled to the claim against her father.
