Male sex offender becomes woman through sex change surgery in order to evade punishment

A transgender man will not have to undergo his sex offender treatment because he is now a woman.

The sex offender was once known as Stuart Fisher of Whitley Bay, North Tyneside, in England. He was sentenced to participate in a program for men after his conviction for behaving in an indecent manner in public.

It is believed to be the first time that officials have been legally forced to change the conditions of punishment for a sex offender because of a sex change.

A Justice Ministry official said: "The adequacy of treatment programs for sex offenders are evaluated on a case by case bases and the decision to change the punishment is a matter for the courts. If an offender is not considered suitable for group courses, their unlawful conduct will have to be dealt with in a one on one basis with the help of a specialist if necessary."

This is a very unusual case, authorities in England have never dealt with a situation like this before. The group program was specifically for men so it was not appropriate for a woman to be in the program.

As the offender became a woman while in the program, something had to change. While the offender wanted to get rid of his punishment altogether for the reason that he cannot do the offense again, the Judge would not hear of it. The judge ordered him to stop the men’s program, and instead, it will be done on a one-on-one basis with a probation officer, said a source close to the case.

Fisher will also have to stay a registered sex offender.
