Man burns his son alive after refusing to pay child support

(Scroll down for video) After her breakup with her baby’s father, Mechelle Gandy of Texas, filed for a child support order for their one-year-old son, Asher Olivas. Her boyfriend, Thomas Olivas, 29, still upset about the breakup, did not want to pay child support.

Arlington Police believe that the child support issue led Thomas Olivas, to kill his ex-girlfriend, and then burn his baby alive.

On the night of March 20, 2011, the bodies of 26-year-old Mechelle Gandy, a single mom, and her son Asher Olivas, were found dead in their burning apartment where they lived alone.

A neighbor at the time, said he heard tires screeching and then the fire broke out.

After the autopsy was done, the medical examiner determined the baby died of burns, but Gandy had been stabbed to death before the fire was set.

Police confirmed that Gandy filed for a child support order against Olivas before he killed her.

Investigators are still collecting evidence and building a case against Olivas. At this time, it is unclear if he will be charged with capital murder for Gandy alone or for both, Gandy and the baby, since he knew his baby is inside the house, and setting fire to the house would definitely kill his son.

Police and U.S. Marshals arrested Olivas in a sports bar on Monday night. He is being held at $1 million bond pending a capital murder charge.
