A woman from DeKalb County, Georgia, who has been arrested a number of times for prostitution, is now accused of raping a 15-year-old boy and giving birth to his baby.

Janelle Denise Goforth, 33, was indicted Tuesday, on two counts of statutory rape after allegedly having sex with the teen on April 25, and April 27, 2011, according to the district attorney's office.

It might have been consensual sex, but according to the law, a 15-year-old boy is underage and cannot consent to sex. In Georgia, where the incident took place, the age of legal consent is 16.

The teen’s guardian, Tia Stephens, learned about her nephew’s sexual encounter with the 33-year-old woman when she allegedly caught Goforth trying to sneak out of her back door with her nephew, who was in the ninth-grade.

The woman claimed that the boy told her that he was 18-years-old.

Stephens warned the woman and informed her of the boy’s age. However, that did not stop Goforth from continuing a sexual relationship with the teen.

One day, Stephens got a call from Goforth’s mother letting her know that her daughter was in labor and about to give birth to her nephew’s baby, that’s when Stephens called police to report the rape.

“She contacted the guardian to notify her that she was in labor and the victim was the father of the child,” police spokeswoman Mekka Parish said.

“It’s at this point that the guardian filed the report. During one of the instances, the guardian confronted the female and informed her of the age of the victim,” Parish said.

A few weeks after the baby was born at DeKalb Medical Center, the teenager saw his baby.

“My nephew asks about his child every day. He asks if I have made a call, or if I had heard anything,” Stephens said.

“He gets depressed at times. I try to get him school-focused and not baby-focused,” Stephens also said.

The teen’s aunt has no contact with the baby, his mother or the couple who is taking care of the child.

“We only see occasional pictures of him posted on Facebook. I have no idea how he’s doing, I want to see him. I want to get to know him. I want to have custody of my nephew’s son,” Stephens said.

Goforth has seven children who are all being taken care of by relatives.

According to jail records, Goforth was arrested on March 26, and released three days later. She has also been arrested in 2005, 2008, and 2012, on charges of loitering for sex, according to DeKalb County jail records.
